These terms incorporate our Privacy Policy and the Client Policy (where applicable) by this reference (collectively called the ‘Licence’). Laytoe Limited, a company registered in England and Wales (No: 10233898) with a registered office at 75 Broughton Street Battersea London SW8 3QB. herein referred to as ‘My Uni Tutors’ or ‘We’ set out the following terms and conditions upon which My Uni Tutors offers a user i.e. the person visiting the Site herein referred to as ‘You’, ‘Your’ and ‘the Client’ a licence to use the Site and the Services.

My Uni Tutors and myunitutor.co.uk are the trading names of Laytoe Limited.

By using any of the Services and the Site, You expressly agree to be bound by this Licence and all applicable laws and regulations governing the Site and the Services. The Licence forms a legally binding contract between You and My Uni Tutors about Your use of the Site and/ or the Services and applies to all users of the Services whether registered or not on the Site and who may also be contributors on the Site.

Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the www.myunitutors.co.uk website (the “Service”) operated by My Uni Tutors (“us”, “we”, or “our”).

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

 

Purchases

You are encouraged to familiarise yourself with your rights contained within the Sale of Goods Act 1979, Unfair Contract Terms Act 1977 and the Unfair Terms in Consumer Contracts Regulations 1999.

If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply three information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or another payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is accurate, correct and complete. You expressly agree that My Uni Tutors is not responsible for any loss or damage arising from the submission of false or inaccurate information.

By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.

We reserve the right to refuse or cancel your request at any time for certain reasons including but not limited to service availability, errors in the description or price of the service, error in your request or other reasons. You expressly agree that My Uni Tutors cannot accept any liability for loss or damage arising out of such cancellation.

We reserve the right to refuse or cancel your request if fraud or an unauthorised or illegal transaction is suspected.

Availability, Errors and Inaccuracies

We are constantly updating our offerings of services on the Service. The services available on our Service may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Service and in our advertising on other websites. You expressly agree that any such offer of a service does not constitute a legal offer capable of attracting legal consequences.

We cannot and do not guarantee the accuracy or completeness of any information, including prices, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice. Section Availability, Errors and Inaccuracies” is without prejudice to existing statutory rights.

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material (“Content”). You are responsible for the Content that you post to the Service, including its legality, reliability, and appropriateness.

You retain any, and all of your rights to any Content you submit, post or display on or through the Service and you are responsible for protecting those rights.

You represent and warrant that: (i) the Content is yours (you own it), or you have the right to use it and grant us the rights and license as provided in these Terms, and (ii) the posting of your Content on or through the Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person.

Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trade mark that is subject to any rights of another individual or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene. You expressly agree that we cannot be held liable for any loss or damage arising out of any misrepresentations you make in this regard.

Applying for a job

When You send or upload Your CV (through Our website or any third parties), You must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination or withdrawal.

My Uni Tutors reserved this right to check the references at any time of receiving Your CV. We will disclose any information we collect, use or receive if required or permitted by law, such as to comply with a subpoena, or similar legal process, and when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

By submitting Your CV (trough Our website or any other third party websites or agencies), you agreed to our Terms and Conditions, Privacy Policies and Cookies Policies.

Please note: Due to the high volume of inquiries that we receive, we are not always able to respond to all CVs. If you have not received a response within one week, please assume that your application has been unsuccessful in this instance.

Intellectual Property

The Service and its original content (excluding Content provided by users), features and functionality are and will remain the exclusive property of My Uni Tutors and its licensors. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of My Uni Tutors.

When you upload content, you give to My Uni Tutors a worldwide, non-exclusive, royalty-free, transferable licence (with right to sub-licence) to use, reproduce, distribute, prepare derivative works of, display, and perform that Content in connection with the provision of the Service and otherwise in connection with the provision of the Service and My Uni Tutors business.

Links To Other Web Sites

Our Service may contain links to third-party websites or services that are not owned or controlled by My Uni Tutors.

My Uni Tutors has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third party websites or services. You further acknowledge and agree that My Uni Tutors shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.

We firmly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

My Uni Tutors Rights & Responsibilities

(i) To reasonably strive to check the identity of the Tutor, and the DBS disclosures. (ii) To help the Tutor and the Client meet, by introducing the Tutor to the Client. (iii) To process each Client’s payments on behalf of the Tutor promptly and pass them on to the Tutor, minus our commission and usually within seven days of a lesson, when there is no Complaint.(iii) We invoice the Client on behalf of the Tutor and payments will only be made once the Client has paid the invoice.(iv) To maintain a functioning Website, including payment processing and communication systems.(v) To effectively try to keep the site free from viruses and worms.(vi) To communicate new Bookings, Confirmation of Bookings, and Cancellations, to both the Client and the Tutor via email or telephone. (vii) To review Complaints to a fair level by immediately notifying the Client and the Tutor of issues raised. We raise the matter with the Tutor, or advise the Client to approach the Tutor directly, in such cases My Uni Tutors takes no responsibilities for the actions of the Client or the Tutor and is solely responsible for its own actions.

PLEASE NOTE: All the sessions MUST be arranged by My Uni Tutors. Any direct arrangement or communication between our Tutor and Client is against the terms and condition, and My Uni Tutors reserves this right to do action against both sides.

Client Responsibilities:

You hereby represent and warrant to My Uni Tutors that: (i) You must be 18 years old or represented by a parent or legal guardian approval or who gives consent for them to receive tuition service. My Uni Tutors is not responsible for any dispute regarding parental consent. (ii) The Client must ensure that any information they provide to My Uni Tutors or www.myunitutors.co.uk is accurate, complete and up-to-date in all material respects. (iii) The Client’s payments must be made through My Uni Tutors. (iv)the Client is responsible for checking the proficiency of the Tutor, My Uni Tutor is not responsible for the Client’s marks and results in anyways. (v) My Uni Tutors takes no responsibilities for the actions of the Client or the Tutor and is solely responsible for its actions.

Deposit 

My Uni Tutors requests £30 per person deposit as an ” Arrangement Fee” to begin the process of matching the Client with the suitable Tutor. If afterward, the Client withdraws or cancels the request, The Arrangement Fee will be forfeit. If My Uni Tutors cannot provide the Client with the suitable Tutor within a week of receiving the Arrangement Fee, we will return the Arrangement Fee automatically. In the case of successfully matched with the Tutor, My Uni Tutors will issue four hours tuition invoice; fee must be made within 48hrs. If the Client doesn’t make a payment for the invoice within 48hrs, The Arrangement Fee will be forfeit. Where the Tutor has been found, but we are not able to reach the Client, or the Client does not answer our emails/ phone calls or take payment of our Invoices, then the Arrangement Fee will be forfeit.

Session’s Cancellation Policy

Any request for cancellation after making a payment of the invoice must be made by telephone or written way to My Uni Tutors (i) If the Client cancels the session 3 days before the arranged start time, you are entitled to a full refund. (ii) If the Client cancels session two days before the arranged start time, you are entitled to a 50% refund. (iii) If the Client cancels session one day before the arranged start time, you are entitled to 20% refund.

 Late Arrival Policy

Where cancellation by either party is made with less than two hours’ notice, or if either fails to arrive at the arranged place and time for a tutorial, this will be considered non-attendance. When the fault is from the Client’s side, the Client will be liable for the full cost of the scheduled session, or any absent period. If the Tutor is at fault, My Uni Tutors will not support a request for payment for any time during which they were not present or engaged in teaching. Either party may, with the agreement of the other, continue the session beyond the planned time-limit, but this will not automatically waive any liability for late arrival, which remains at the discretion of the disadvantaged party.

Termination

We may terminate or suspend Your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach the Terms. Upon termination, Your right to use the Service will immediately cease. If You wish to terminate Your account, You may just discontinue using the Service.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Marks and Results

By using the Service you have agreed that My Uni Tutors is not responsible for any claims by the Client related to Tuition, or the Client’s marks or results. My Uni Tutors supports the You in Your lessons but doesn’t have any guarantee or responsibility for Your marks or results in anyways.

Indemnification

You agree to defend, indemnify and hold harmless My Uni Tutors and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debts, and expenses (including but not limited to attorney’s fees), resulting from or arising out of (i) Your use and access of the Service, by You or any person using Your account and password; (ii) a breach of these Terms, or (iii) Content posted on the Service.

 

Limitation Of Liability

In no event shall My Uni Tutors, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) Your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of Your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not We have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose. (v) My Uni Tutors has no responsibility for the actions of the Client or the Tutors and is solely responsible for its own actions.

Disclaimer

Your use of the Service is at Your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

My Uni Tutors and its subsidiaries, affiliates, and its licensors do not warrant that (i) the Service will function uninterrupted, secure or available at any particular time or location; (ii) any errors or defects will be corrected; (iii) the Service is free of viruses or other harmful components; or (iv) the results of using the Service will meet your requirements.

Please Note: We do not write dissertations, essay or coursework for students. We teach and advise on content, style and structure. My Uni Tutors always seeks to ensure that the strictest academic standards are adhered to by our tutors. 

Plagiarism

My Uni Tutors does not promote, condone or tolerate unethical academic practices. Such practices include, but are not limited to plagiarism and intellectual property violation. Requests for any such practices will result in the immediate cancellation of My Uni Tutors’ service offer, and disciplinary action up to and including dismissal of the Tutor. Full responsibility for the content of any academic work submitted to any institution rests with the Client, and My Uni Tutors will not accept liability for plagiarism and/or the consequences therein.
My Uni Tutors reserves the right to determine what constitutes a request for unethical practice and to refuse My Uni Tutors’ services to anyone expressing such a request. Any individual deemed to have made such a request (enacted or otherwise) ceases to be a Client of My Uni Tutors, and forfeits their right to any assistance or protection under these Terms.

Exclusions

Without limiting the generality of the foregoing and notwithstanding any other provision of these terms, under no circumstances will My Uni Tutors ever be liable to You or any other person for any indirect, incidental, consequential, special, punitive or exemplary loss or damage arising from, connected with, or relating to Your use of the Service, these Terms, the subject matter of these Terms, the termination of these Terms or otherwise, including but not limited to personal injury, loss of data, business, markets, savings, income, profits, use, production, reputation or goodwill, anticipated or otherwise, or economic loss, under any theory of liability (whether in contract, tort, strict liability or any other theory or law or equity), regardless of any negligence or other fault or wrongdoing (including without limitation gross negligence and fundamental breach) by My Uni Tutors or any person for whom My Uni Tutors is responsible, and even if My Uni Tutors has been advised of the possibility of such loss or damage being incurred.

Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is a material, we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, You must stop using the service
